Our legal experts will explain:

  • key employment law decisions from the last six months and how these might impact on your practices; and
  • important legislative and Government policy developments that are relevant to HR. 

In our case law update, we will consider three recent EAT decisions exploring:

  • the importance of conducting a thorough investigation and following a fair procedure when dismissing an employee for misconduct, as well as the impact that procedural failings that amount to breaches of the ACAS Code can have on the employee’s compensation;
  • whether protecting a disabled employee’s pay when they move into a more junior role is a reasonable adjustment; and
  • whether ‘gender critical’ beliefs (e.g. that biological sex is an immutable fact) qualify for protection as philosophical beliefs under the Equality Act – and the implications for employers if they do.

We will also take a look at some recent Employment Tribunal decisions dealing with issues arising out of the Covid-19 pandemic, such as whether redundancy dismissals can be fair where furlough exists as a potential alternative and the circumstances in which employees can refuse to attend the workplace due to concerns about health and safety.

We will then share insights on key legislative and policy developments, including:

  • an HR-focused update on Covid-19;
  • gender pay gap reporting - EHRC will begin enforcement action from 4 October 2021;
  • GDPR; and
  • changes to right to work checks for EU nationals from July 2021.

The webinar will conclude with a Q&A session for you to ask questions of our expert speakers.
