Facing an Employment Tribunal claim can place real pressure on your business. Alongside the legal issues, you need to manage deadlines, gather evidence and support the people involved, while keeping day-to-day work moving.

Make UK’s employment law team can support you throughout the process, from preparing your response to representing your business at the final hearing where we have a 95% success rate. We bring a pragmatic approach to managing your case, with advice that helps you make informed decisions at each stage.

A growing concern for employers

From 1 October 2026 the limitation period for bringing most employment tribunal claims has doubled from 3 months to 6 months while. Then from 1 January 2027, the qualifying period for ordinary unfair dismissal protection will reduce from two years to six months, and the cap on compensatory awards for unfair dismissal will be removed.

For employers, this makes fair processes, clear records and timely legal advice increasingly important. If a dispute develops into a claim, having the right support can help you understand what is being alleged, assess your position and plan your response.

Single Employment Tribunal claims increased by 28% in April to June 2026 compared with the same period a year earlier, according to the Ministry of Justice.

Support throughout your case

Every case has its own facts, pressures and priorities. We can manage the work involved from your initial Tribunal response through to the final hearing, including settlement discussions where appropriate.

  • Preparing your response: We can prepare your ET3 response, setting out your business’s position and its response to the allegations. We work with you to understand the events behind the claim and identify the information needed to prepare your case.

  • Preliminary hearings and opportunities to resolve the dispute: Our team can prepare for and represent your business at preliminary hearings, dispute resolution appointments and judicial mediations. We can also manage settlement discussions, helping you assess whether an agreed resolution is appropriate for your business.

  • Preparing the evidence: Preparing for a hearing involves bringing together the documents and witness evidence relevant to the case. We can manage document disclosure, prepare the hearing bundle and work with witnesses to prepare their statements. Throughout this work, we keep the case strategy and your business’s priorities in focus.

  • Representation at the final hearing: If the case proceeds to a full hearing, we can prepare for and represent your business at Tribunal, presenting your case and responding to the claimant’s arguments and evidence.

Our support in practice: Resolving a discrimination claim before a six-day hearing (Case study)

An employer faced race and disability discrimination claims from a former employee, whose claimed losses totalled around £89,000. The case was due to proceed to a six-day Employment Tribunal hearing.

Our team prepared the employer for mediation, developed a settlement strategy and prepared the supporting documents. We represented the employer during negotiations, advising as discussions progressed and drafting the settlement agreement once terms were agreed.

The claim settled for £9,000 a few days after mediation. This avoided the six-day hearing and more than £30,000 in estimated barrister’s fees, while reducing the management time required. A key witness also avoided having to give evidence, addressing one of the employer’s main concerns.
